We were instructed by the Agriculture and Food Authority (AFA) to undertake a legal audit on the transition process of the agriculture and food authority to independent boards. The Audit was to determine possible legal risks that could arise as a result of transition to independent authorities or Boards. We recommended the implementation of our recommendations by AFA to ensure that the transition process does not face unnecessary legal and other challenges, including risks of loss of assets and other properties. Our recommendations focussed on the Physical and movable Assets, Staff, Contracts with third parties, Intellectual property, Staff Pension, Licences, Permits and Authorisations, pending applications, requests, Litigation and other disputes, Administrative structures, Shared services, Reference to written law, Consequential amendments and Draft savings and transition clauses.
